By using the Your Choice VoIP website, you agree to be bound by the Your Choice VoIP Terms & Conditions set out below.

In the following terms and conditions, the words Your Choice VoIP, we, and our are used to refer to OK Telecoms.

You accept e-mail as a valid means of communication of any agreement between you and Your Choice VoIP.

You must check that the details of your confirmation email are correct as soon as possible and you should print out and keep a copy for your records. This confirmation e-mail amounts to an acceptance by Your Choice VoIP (or 3rd party supplier that is engaged on your behalf by Your Choice VoIP) of your offer to buy goods from Your Choice VoIP and this acceptance is effective regardless of whether or not you receive the e-mail.

Your Choice VoIP are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.

Price and availability information is subject to change without notice.


Rule Modification

Periodically, changes in these terms may be required to comply with regulatory or business requirements. Such changes will be published on the company website (www.yourchoicevoip.com), and notifications may be sent to you via email, depending on the nature of the change. Continued use ofYour Choice VoIP products and services both before and after such changes, signifies irrevocable acceptance to the Terms of Use. Sipgate reserves the right to change, modify, suspend or discontinue any portion of the Service at any time. Your Choice VoIP may also impose limits on certain features or restrict your access to parts or the entire Service without notice or liability.


Eligibility

The Service is available to individuals who are eighteen (18) years of age or older as well as corporations and other organizations who can form legally binding contracts under applicable law. By accepting these Terms, you signify that you meet these qualifications of eligibility. Your Choice VoIP may refuse to offer the Service to any person or company, and may change our criteria for eligibility, at any time, at its sole discretion. Your Choice VoIP retains the right to terminate your account and your rights to use the Your Choice VoIP products and services for any reason including but not limited to our belief or suspicion that any registration data you provide is or becomes untrue, inaccurate, not current, or incomplete.


Service Modification

Your Choice VoIP cannot guarantee that the service will be uninterrupted or free of faults. At times Your Choice VoIP may need to suspend service to correct a fault or for maintenance purposes. If this happensYour Choice VoIP will restore the service to you as quickly as reasonably possible. Your Choice VoIP reserves the right to modify or discontinue service, temporarily or permanently, with or without notice to you, andYour Choice VoIP are not obligated to support or update our service. Your Choice VoIP will not be liable to you or any third party in the event that Your Choice VoIP exercises our right to modify or discontinue service.

Use of Service

By accepting these terms, you are agreeing NOT to allow through your actions, or those of another, the use of services from Your Choice VoIP for unlawful or illegal purposes; including but not limited to making offensive, indecent or prank/hoax calls, allowing others to do so, using the services fraudulently, to commit or further a criminal offence. You are agreeing NOT to cause damage to this or any other communication or data system, and you fully indemnify Your Choice VoIP against any liabilities (including such things as legal expenses, losses, costs, claims and damages), brought about by your action or inaction in violation of this agreement. You may NOT submit or publish through Your Choice VoIP any materials that are libelous, defamatory, pornographic, an invasion of privacy, obscene, abusive, illegal, racist, offensive, an infringement on any intellectual property rights of a third party or would otherwise violate the rights of any third party. You will comply with all reasonable instructions provided by Your Choice VoIP in relation to the service.


Processing of orders

Your Choice VoIP aim to ship all items of hardware within 24 hours of receiving your order but your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable. We regret we are not able to supply dates when our suppliers may get an item in stock. Please note that your order may be sent to you in installments.

Credit and debit cards are debited before items are shipped by Your Choice VoIP. All prices include sales taxes (where applicable) at time of order and will be clearly displayed, unless otherwise stated.

Sales tax applies to all residents in the European Union in the form of Value Added Tax, if the customer resides outside the European Union he/she is exempt from paying Value Added Tax and will be refunded once the order has been completed. The amounting sales tax will be credited back to the account used to pay for the goods or services offered by Your Choice VoIP.


Limitation of Liability

This liabilty section applies only to the extent permitted by law.

Except as set out below, neither Your Choice VoIP nor any of their directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site.

VoIPtalk does not limit its liability for death or personal injury to the extent only that it arises as a result of negligence of Your Choice VoIP, its directors, employees or other representatives.

Your Choice VoIP does not accept liability (except as set out below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.

Your Choice VoIP does not accept liabilty for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use of the Your Choice VoIP website or for any products purchased from the Your Choice VoIP website. Your Choice VoIP will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.


Confidentiality and Privacy

Your Choice VoIP Confidential Information. You agree to take all reasonable steps at all times to protect and maintain any confidential information regarding Your Choice VoIP, its Affiliates, the Your Choice VoIP Staff, and the IP Rights, strictly confidential.

Your Confidential Information and Your Privacy. Your Choice VoIP is committed to respecting Your privacy and the confidentiality of Your personal data. The Privacy Policy that is published on the Your Choice VoIP Website applies to the use of Your personal data, the traffic data as well as the content contained in Your communication(s).


EMERGENCY SERVICES (999,911,112)

Your Choice VoIP is not a telephony replacement service and cannot be used for emergency dialing.

The use of emergency service numbers are currently unavailable on the Your Choice VoIP network, therefore please make alternative arrangements should an occasion occur where an emergency service is required. Your Choice VoIP can not be held responsible if there are no alternative arrangements in place to call an emergency service.


Termination

This Agreement will be effective as of the Effective Date and will remain effective until terminated by either Your Choice VoIP or You as set forth below.
Termination by Your Choice VoIP. Your Choice VoIP may terminate this Agreement at any time, with or without cause, by providing notice to You and/or by preventing Your access to the Your Choice VoIP Customer Control Panel.

Termination by You. You may terminate this Agreement at any time, with or without cause, provided that You will meet with the conditions set forth by Your Choice VoIP.


Jurisdictional Issues

This Service is controlled and operated by Your Choice VoIP. Your Choice VoIP makes no representation that materials in the Service are appropriate or available for use in your location. Those who choose to access this Service from any location do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.


Indemnity

You agree to indemnify and hold Your Choice VoIP, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another person or entity.


Governing Law

This Service shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.


Modification of Terms

Your Choice VoIP reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Your Choice VoIP site. These terms and conditions will apply to your order once you have received your confirmation email. They will supercede any other terms and conditions in whatever form given. Please print and retain a copy of the terms and conditions once you have received your confirmation email.


Fair Usage Policy

The Fair Usage Policy applies to certain tariffs offered by Your Choice VoIp where terms such as "Free" or "Unlimited" are stated, whether it be in an advertisement for Your Choice VoIP or on the site itself.

Where the term "Unlimited" is stated, a fair usage of 2500 minutes are allocated, any minutes used above this allowance will be charged at the curent rate for the destination being called.

The length of a single call is restricted to 60 minutes after which the line will be terminated and you will be required to dial again to reconnect to the service.
